C. STATE REENTRY LEGISLATION, INITIATIVE

California Department of Corrections and Rehabilitation (CDCR) – Reentry Services: https://www.cdcr.ca.gov/adult-operations/reentry-services/ Through extensive community partnerships, innovative community supervision, and a commitment to rehabilitation, CDCR is helping offenders succeed as they return to their communities. Comprehensive pre- and postrelease rehabilitative programs and services are offered in communities throughout California and are delivered through alternative custody, residential, outpatient, and drop-in centers.

The mission of this private, nonprofit organization is to assist people incarcerated in California prisons with a successful reentry by providing education and connecting them to resources before release, with the goal of reducing recidivism. Program activities in support of the mission include:

§ assisting in developing parole plans,

§ assisting in developing solid relapse prevention plans,

§ assisting in developing social skills,

§ holding weekly life-skills workshops,

§ coordinating clients' reentry needs with CDCR counselor,

§ assisting in obtaining services in communities of reentry,

§ promoting public support for reentry programs,

§ advocating publicly for reentry reform, and

§ providing a replicable model for reentry programs.

§ In California, the highest age an individual's alleged conduct can be considered delinquent is 17. Cal. Welf. & Inst.Code § 602. The lowest age for an adjudication of delinquency is not specified. Once a child has been adjudicated delinquent, jurisdiction of the juvenile court may extend through age 24 (up until age 25). Cal. Welf Inst.Code § 607; § 607.1; § 1769.

§ Discretionary waiver: At a hearing, the Juvenile Court judge makes the decision and/or verifies that criteria are met before waiving the court’s jurisdiction for prosecution in (adult) criminal court.

§ Once/always adult: The legislature makes the decision based on a minor’s prior history in (adult) criminal court, or mandates are based on a minor’s prior history in (adult) criminal court.

§ Reverse waiver (remand): The criminal court judge can transfer the matter to juvenile court for adjudication and/or disposition.

§ Criminal blended sentencing: Juvenile court can impose juvenile dispositions and/or adult criminal sanctions while retaining jurisdiction.
